you will not get serviced as a first run theater if you only have 40 seats. Your gross potential with only 40 seats will not be worth it to the film companies to even give you a print of a film.
I'm not so sure about that. There is a theater near here that has 3 screens, one with 200 seats and the other two with 45 seats each. They open new movies in the 45-seaters all the time. For today's "wide" releases the studios will often take anything they can get. As far as gross potential....if you do 2 shows a day, at $10 per ticket you could potentially gross $800 a day or $5600 a week with 40 seats. Obviously that'll never happen but it's not like it's impossible.
This is another reason he needs a booker. If you are flying solo, you may never get a studio to pay attention with 40 seats, but a booker can swing a little more weight.
For reference, here we have 104 seats and our "average" is around 30 people a night.
